W dniu 1 września 2003 r. weszły w życie nowe uregulowania dotyczące osób ubiegających się w Polsce o nadanie statusu uchodźcy. Zamiast jednej ustawy o cudzoziemcach, regulującej zagadnienia wjazdu, wyjazdu, przejazdu i pobytu cudzoziemców na terytorium RP oraz, w dosyć ograniczony sposób, sprawy uchodźców, azylu i ochrony czasowej, powstały dodatkowo dwa odrębne akty, tj. Ustawa z dnia 13 czerwca 2003 r. o udzielaniu cudzoziemcom ochrony na terytorium Rzeczypospolitej Polskiej (Dz.U. z 2003 r. Nr 128, poz. 1176) oraz Ustawa z dnia 20 czerwca 2002 r. o zasadach i warunkach wjazdu i pobytu obywateli państw członkowskich Unii Europejskiej oraz członków ich rodzin na terytorium Rzeczypospolitej Polskiej (Dz.U. z 2003 r. Nr 140, poz. 1180). Już podczas prac nad tą ustawą dostrzeżono, że z ustawy o cudzoziemcach powinny być wyodrębnione przepisy dotyczące udzielania ochrony cudzoziemcom wymagającym, zgodnie ze standardami międzynarodowymi, szczególnego traktowania. Opracowano więc odrębny akt prawny, tj. wymienioną powyżej ustawę o udzielaniu cudzoziemcom ochrony na terytorium Rzeczypospolitej Polskiej, w którym uregulowano postępowanie wobec obcokrajowców, którzy ubiegają się o nadanie statusu uchodźcy, udzielenie azylu, ochrony czasowej lub zgody na pobyt tolerowany. W niniejszej publikacji dokonano szczegółowego omówienia przepisów przedmiotowej ustawy, wykorzystując w tym celu dostępne materiały źródłowe oraz własne doświadczenia autorki. Podjęto też próbę precyzyjnego przybliżenia tematu związanego z cudzoziemcami oraz wymieniono mankamenty omawianej regulacji w kontekście działań podejmowanych przez Agencję Bezpieczeństwa Wewnętrznego zgodnie z jej właściwością rzeczową.
On 1 September 2003 new regulations came into effect relative to individuals applying for the refugee status in Poland. Instead of a single Act on Aliens regulating the issues of entry into, departure from, transit through and residence of aliens on the territory of the Republic of Poland and – in a fairly limited way – the issues of refugees, asylum and temporary protection, two additional, separate acts were created, i.e. the Act on granting protection to aliens within the territory of the Republic of Poland dated 13 June 2003 (Journal of Laws No. 128, item 1176) and the Act on the principles and conditions governing entry into and stay of citizens of the EU countries and their family members on the territory of the Republic of Poland dated 20 June 2002 (Journal of Laws No. 140, item 1180). Already during work on the Act, its authors recognized that rules on providing protection to aliens demanding, according to international standards, a special treatment should be excluded. Therefore, a separate Act, i.e. the mentioned the Act on granting protection to aliens within the territory of the Republic of Poland, has been elaborated that regulates the proceedings relative to aliens who apply for the refugee status, asylum, the permit for tolerated stay, temporary protection. The article presents a detailed discussion of the provisions of the Act in question based – to this end – on accessible source materials and the author’s own experience. Additionally, the paper attempts to describe precisely the issue of aliens and enumerates the deficiences of the mentioned Act in the context of the actions taken by the ABW in accordance with its statutory powers.
